Terms of Service
Last updated: [Effective date]
These Terms of Service (“Terms”) apply to your use of partsintelligence.ai (the “Site”), run by Turnquist Elstins Technology Group LLC DBA Fyresite (“Fyresite”, “we”, “us”). Parts Intelligence is a Fyresite product. By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
What the Site is
The Site explains Parts Intelligence and the services Fyresite offers around it, and lets you book a demo, watch webinars and download resources. Nothing on the Site is an offer to sell or a binding commitment to provide any product or service. If you become a client, the work is governed by a separate written agreement (such as a master services agreement and statement of work), and that agreement controls if it conflicts with these Terms.
Information on the Site
We work to keep the Site accurate, but it’s provided for general information only.
- Results vary. Figures on the Site, such as conversion rates, returns, revenue and SKU counts, come from specific client implementations and the conditions at the time. They aren’t a promise or a forecast of your results.
- Features change. Features marked “Coming soon” and any roadmap items are plans, not commitments. We may change, delay or drop them.
- Third-party products. Shopify, Algolia and other platforms named on the Site are run by their own companies. Their availability, pricing and terms are set by them, not by us.
Demos and calls
Booking a demo or a call doesn’t create a client relationship or any obligation on either side. Anything you share before a written agreement is signed is treated under our Privacy Policy, and you shouldn’t share confidential information until a written agreement or NDA is in place.
Downloads, videos and other content
The text, graphics, demos, videos, one-pagers, whitepapers, code and design of the Site are owned by Fyresite or its licensors and are protected by copyright and other laws. You may view the Site and download our resources for your own business’s internal evaluation of Parts Intelligence. You may share our links and resources in full with your team. You may not sell, republish, modify or present our content as your own.
Trademarks
Fyresite Parts Intelligence™ is a trademark of Fyresite. Shopify, Algolia, SEMA and PRI marks belong to their respective owners, and their use on the Site doesn’t mean those companies endorse us beyond any stated partnership.
Acceptable use
When you use the Site, you agree not to:
- Copy, scrape or harvest the Site or its content with automated tools, other than search engine crawling that follows our robots rules.
- Try to reverse engineer, probe or interfere with the Site, its interactive demos or its security.
- Submit false information, someone else’s information without permission, or spam through our forms or scheduling tool.
- Upload or send anything unlawful, harmful or infringing, or anything containing malware.
- Use the Site in a way that breaks the law or harms Fyresite, our clients or other visitors.
We may block access or remove submissions that break these rules.
Feedback
If you send us ideas or feedback about Parts Intelligence, we may use them without owing you anything. This doesn’t give us rights to your store data or your confidential information, which are governed by your agreement with us if you become a client.
Third-party links and services
The Site links to and uses services run by others, such as Calendly for scheduling, YouTube for videos, fyresite.com and partner sites. We don’t control them and aren’t responsible for their content or practices. Their own terms and privacy policies apply when you use them.
Disclaimer
The Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that the Site will always be available, error free or secure.
Limitation of liability
To the fullest extent the law allows, Fyresite and its owners, employees and partners won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site or its content, even if we were told they were possible. Our total liability for any claim about the Site is limited to one hundred U.S. dollars (US$100). Some places don’t allow these limits, so they may not fully apply to you.
Indemnity
If you use the Site in a way that breaks these Terms or the law, you agree to cover the reasonable costs, including legal fees, of any claim against Fyresite that results.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute about the Site or these Terms will be resolved in the state or federal courts located in Maricopa County, Arizona, and you and we agree to that jurisdiction.
Changes and ending access
We may update these Terms as the Site changes. We’ll post the new version here and change the date at the top; using the Site after that means you accept the update. We may change or stop offering any part of the Site at any time.
General
If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce a part of these Terms right away, we can still enforce it later. These Terms and our Privacy Policy are the whole agreement between you and us about the Site.
